PROCEDURE FOR OBTAINING LETTER OF ADMINISTRATION IN NIGERIA
INTRODUCTION
Letter of administration in Nigeria is the legal authority granted by the Probate Court to a person called the administrator or administratrix to administer the estate or property of a person who died intestate.
A person is said to have died intestate when he dies without leaving behind a valid Will. The administrator then derive his or her authority to act from the terms of the letters of administration, and where the letters of administration is not granted, an administrator lacks the authority to act as the properties of the deceased are deemed to be vested in the Chief Judge of the State.
Section 49(1) Administration of Estate Law, Lagos state laid down the persons that can apply for a grant of letter of administration in order of priority and where they are of equal priority, the court has discretion to select any who in its view is most suitable. These persons are generally called NEXT-OF-KIN of the deceased. Thus generally, it is the next-of-kin of the deceased that is entitled to apply for letters of administration in the following hierarchy:
– Surviving spouse(s) of the deceased
– Children of the deceased
– Parents of the deceased
– Brothers or sisters of the deceased of full blood or the children of such brother or sister who died in the life time of the deceased.
– Brother or sister of the deceased of half-blood or the children of such brother or sister who died in the life time of the deceased
– Grandparents of the deceased
– Uncles and aunts of full blood or their children
• PROCEDURE FOR OBTAINING LETTER OF ADMINISTRATION
Letters of administration is granted upon application by a person entitled either personally or through his legal practitioner to the Probate registrar. Usually forms are issued to the applicant, to be returned, upon completion, to the probate registry.
Grant of letters of administration would not be made within three (3) months (in Lagos state) from the death of the testator where he died intestate and every application for grant of letters of administration are usually published to allow for objections and the filing of caveats.
It must be noted that letters of administration cannot be transferred or inherited. Furthermore, one person cannot be granted letters of administration. It can only be granted to at least two people. The only exception is where a Trust Corporation or the administrator general is appointed as sole administrator. The procedure for the application is as follows:
1) Application is made to the probate registrar. The letter should contain the following
– Full names of the deceased
– Date of death of the deceased
– Place of residence of the deceased shortly before his death
– Name of proposed administrators
2) The application shall be accompanied with the death certificate. Upon submission of the application, then forms will be given. Such forms include:
– Oath of Administration by the applicants
– Particulars of landed property left by the deceased
– Administration Bond to ensure that the grantee makes proper inventory, distributes the estate accordingly and pays out of all just debts.
– Affidavit/Declaration as to next-of-kin
– Bank certificate
– Inventory
– Passport photographs of applicant
– Justification for sureties
– Schedule of debts and funeral expenses
3) The forms upon filling them would be submitted
4) Publication would be made in the gazette or newspaper. This, in essence, is to invite and give the public or any interested person the opportunity to object and file a caveat to the grant of letters of administration to the applicant.
5) Objection may be raised within specified period for filing a caveat
6) Once no objection, upon the payment of the estate duties, the letters of administration would be granted.
• COST OF LETTER OF ADMINISTRATION
There are various fees to be paid before letters of administration application can be evaluated and approved. Once letters of administration is approved by the Probate Registry, an Estate fee of 5% to 10% of the value of the Estate, depending on the State must be paid to the State Government where the Letters of administration application is made and approved.
• ADMINISTRATION OF ESTATE LAW NIGERIA
The law that regulates the Estates of deceased persons, is the Administration of Estates Laws of different states of the federation of Nigeria.
The Administration of Estate Laws in Nigeria provide for a legal system of administration of the estate of deceased persons which entails the verification of the claims of persons claiming to be entitled to the estate of deceased persons and subsequently grant the authority or power to administer the estate to the persons who have passed through the verification process at the Probate Registry.
The Administration of Estates Law of Lagos State was as a result of adoption of a similar Administration of Estates Law of former Western State of Nigeria.
The Law was made with the intent to forestall the properties left behind by deceased persons from falling into the hands of unscrupulous persons and particularly those the deceased would not ordinarily wished to inherit his or her properties.
The Law do not apply to the distribution, inheritance or succession of the Estate of a deceased person whose affairs were regulated by customary law during his or her lifetime.
• CONCLUSION
The entire process of obtaining Letters of Administration of an Estate can be cumbersome and grueling especially for persons not familiar with the process, because it deals with inheriting an estate of intestate persons.
However, the administrative of estate laws operated by different states in Nigeria have provided minimum guidelines on how the estate falling into intestacy can be carefully administered by the deceased next of kin.

Professor Yemi I sunbajo’s firm, Simmons Coopers is fingered in Alleged N100bn Alpha Beta Scam
A company in which Vice-President Yemi Osinbajo has a stake, Simmons Coopers Partners, has been linked to another firm, Ocean Trust Limited, which was fingered in an alleged N100bn scam involving Alpha Beta Consulting Limited and Alpha Beta LP.
Ocean Trust Limited, which was accused of being a conduit for diversion and laundering of funds by Alpha Beta, listed Simmons Coopers as its company secretary, documents exclusively obtained from the Corporate Affairs Commission by Saturday PUNCH showed.
Simmons Coopers was listed as a company in which Prof Yemi Osinbajo (now Vice-President) had a stake in his asset declaration form in 2015, according to the statement by the Senior Special Assistant to the President on Media and Publicity, Garba Shehu.
In a petition submitted to the Economic and Financial Crimes Commission in July 2018, Dapo Apara, the erstwhile managing director of Alpha Beta, had alleged that Alpha Beta owed the Federal Government N100bn in unpaid taxes spanning over 10 years, adding that the firm usually laundered funds through another firm, Ocean Trust Limited.
He alleged that the firm was being protected by powerful politicians.
The petition by Apara’s lawyer, Adetunji Adegboyega, read in part, “Over the years, the company (Alpha Beta) has been protected and shielded by some powerful politicians and people in the society which made them to always boast of being untouchable.
“But our client, feeling the need not to keep quiet again and strengthened by his belief in the fact that the government of President Muhammadu Buhari is keen on fighting corruption which has been the bane of our country, is of the firm view that it is time to expose and open the can of worms called Alpha Beta Consulting.
“Our client is of the firm belief that it is time for the commission to step in and conduct a holistic investigation into the activities of Alpha Beta Consulting Limited and Alpha Beta LLP with a view to uncovering the massive corruption, money laundering, tax evasion, etc., going on in the company.
“Kindly note that one of the companies being used to perpetrate money laundering by the company is still another company named Ocean Trust Limited.”
Osinbajo’s reaction
When contacted on the relationship between Osinbajo’s firm, Simmons Coopers and Ocean Trust, the Senior Special Assistant to the Vice-President on Media, Mr Laolu Akande, said he would not comment on the matter unless Saturday PUNCH showed him the document indicating Simmons Coopers was Ocean Trust’s company secretary.

The resumption of academic activities in both elementary and secondary schools in Nigeria has been announced by the Federal Government of Nigeria through the Federal Ministry of Education. Academic activities have been scheduled to resume for 3rd term 2022/2023 academic session.
School Resumption Date For Primary & Secondary Schools
In order to harmonize the academic and non activities in all primary and secondary schools in Nigeria, the federal government has directed that all schools (primary and secondary, private and public) resume on the same date.
The official resumption date for all schools has been fixed by the ministry of education as Monday 9th May 2022. This is to keep all academic activities in line the the approved academic calendar for the 2022/2023 academic session.
The resumption date above is binding on all schools including all Unity schools (Federal and State government colleges) across the nation. The 3rd term has been scheduled to run for a period of 3 and a half months in order to meet up with the September resumption which marks the beginning of a fresh academic session.
The federal ministry of education stated that all Federal Government Colleges (unity schools) shall resume as follows:
Junior Secondary School (Day and boarding students) – Sunday 8th of May 2022
Senior Secondary Schools (Day and boarding students) – Monday 9th May 2022.
All parents and guardians are to take note of the above information on behalf of their wards.

Lady Slumps & Hospitalized After Boyfriend Refused To Propose To Her In Lagos

There was chaos in Ikotun on Tuesday afternoon as a lady, identified as Linda Majekodunmi slumped on Oja, Bus Stop, Ikotun Old Garage, after her boyfriend, Fabian failed to propose.
Eyewitness said the two young people have been head over heels in love with each other for a long time with marriage in view.
But it seem the guy had a change of mind as he refused proposing Linda.

Federal Government, in conjunction with Lagos State Government (LASG) ordered the stoppage of barge operations

The Lagos Marina is set to regain its beauty and serenity, with the planned stoppage of barge operations along the coastline, according to a statement issued yesterday by the Lagos State Commissioner for Information and Strategy, Mr. Gbenga Omotoso.
The federal government, in conjunction with Lagos State Government (LASG), yesterday ordered the stoppage of all such operations, which have desecrated the once beautiful and peaceful Marina coastline.
The Nigerian Ports Authority (NPA) is to revoke barge approvals granted some companies operating in Lagos.
The Minister of Transportation, Hon. Rotimi Amaechi, and the Lagos State Governor, Mr. Babajide Sanwo-Olu, who defied the early morning downpour to inspect activities around the Marina coastline, made the stop-work order during an unscheduled visit to the Marina.
They went around the coastline, seeing the long row of trucks and containers that have constituted health and security hazards on the Marina.
Amaechi and Sanwo-Olu kept on shaking their heads on seeing the devastation of the coastline that used to be the pride of the state, attracting crowds of visitors.
Amaechi and Sanwo-Olu found the “unwholesome” activities on the coastline “shocking” and “unacceptable.”
The minister spoke of an urgent need to sanitise the entire Marina coastline and restore its tranquility and beauty.
He ordered that trucks must immediately stop coming to Marina to load.
Amaechi said the National Inland Waterways Authority (NIWA) did not grant anyone the permission to carry out barging operations, insisting that all such activities must stop immediately.
“The Federal Ministry of Transport has agreed with Lagos State Government to ensure that whoever is making use of Marina coastline should stop. We have agreed with Commissioner of Police to stop those using the roads and we have agreed with NPA to cancel all barge permits pending when each person will come back to NPA, NIWA and Lagos State Government to renew such approval,” he said.
Sanwo-Olu directed the Lagos State Commissioner of Police to arrest and prosecute anyone who flouts the order to stop unauthorised activities on the Marina.
He said the state government would do everything to bring sanity to the coastline.
“We are also talking to the Federal Ministry of Works and Housing because we understand that some of the approvals were from the Federal Ministry of Works. So, we are also taking up that responsibility and we would do what we need to do,” the governor said.
Also at the inspection were the Managing Director of NPA, Ms. Hadiza Bala-Usman, and representatives of NIWA, Ministries of Works and Waterfront as well as the Police.

United Kingdom To deploy observers in Edo and Ondo States to monitor the governorship elections

The United Kingdom yesterday said it would deploy observers in Edo and Ondo States to monitor the governorship elections, and threatened sanction, including a travel ban to the United Kingdom, against sponsors of violence in the two elections.
The UK said the British High Commissioner to Nigeria, Catriona Laing, had met with the leaders of the ruling All Progressives Congress (APC) and the main opposition, the Peoples Democratic Party (PDP).
The decisions of the UK Government were contained in a statement issued yesterday in Abuja by the High Commission to Nigeria.
The statement said: “As a friend and partner of Nigeria, we are closely following the lead up to the off-cycle governorship elections in Edo and Ondo states scheduled for September 19 and October 10, respectively.
“These elections are important, both as an essential element of effective governance within both states and an indicator of the strength of Nigeria’s democratic institutions.
“Our High Commissioner to Nigeria, Catriona Laing, has held meetings with leaders of the two main political parties, the APC and PDP.
“The discussions focused on the need for the parties’ leaders to prevail on supporters to avoid violence before and after the elections and we welcome the Edo candidates’ signatures of the National Peace Committee and INEC convened a peace accord yesterday.
“We will be deploying observation missions to both the Edo and Ondo elections and supporting civil society led observation.
“The UK takes a strong stand against election-related violence and, just as we did in the general election in 2019, will continue to take action against individuals we identify as being responsible for violence during the elections.
“This could include restrictions on their eligibility to travel to the UK, restrictions on access to UK based assets or prosecution under international law.
“The UK will continue to provide support and engagement as we move towards these elections. We urge INEC, the Police and all other agencies involved to work together to deliver free, fair and credible elections.”

Africa Initiative for Governance announces the recipients of the 2020/2021 round of its scholarships

Africa Initiative for Governance (AIG), a not-for-profit organisation founded to inspire the transformation of Africa’s public sector, has announced the recipients of the 2020/2021 round of its scholarships for young, outstanding West Africans with a passion for public service.
In a statement issued yesterday by the organisation in Lagos, Founder and Chairman of AIG, Mr. Aigboje Aig-Imoukhuede said, “AIG has a vision of a public sector in Africa that is effective, values-driven, service-oriented and results-focused.”
He said, “To support the attainment of this vision, we are proud to invest in the development of a critical mass of transformation champions who can lead this transformation process.”
In her comments, the Chief Executive Officer of AIG, Ms. Chienye Ogwo said, “The AIG Scholarships selection process is particularly rigorous and, each year, progressively attracts exceptional talent with potential for great achievement. We are pleased to announce this new cohort of five women and one man, and honoured to support their commitment to public service.”
The statement noted that AIG has awarded at least five scholarships to talented West Africans from all academic backgrounds to pursue the Master of Public Policy at the Blavatnik School of Government, University of Oxford every year, since 2017.
AIG had signed a partnership with the Blavatnik School of Government at the University of Oxford in June 2016 based on a shared vision of improving the world through good governance and public leadership. AIG also awards the AIG Fellowships at the School, to outstanding senior public service officials from West Africa. To date, 25 men and women have benefited from AIG Scholarships and Fellowships.
The AIG scholars, usually people who are passionate about the public sector, are expected to return to their home country upon graduation and apply their learning experience as change agents in their country’s public sector. For the fourth round, the fully funded scholarships were awarded to Adejoke Are, Murjanatu Mohammed Audu, Uchechukwu Nwokediuko, Chioma Oparadike, Folasade Osho and Victoria Udom.
Commenting on the award, one of the 2020 AIG Scholars and a first-class graduate of Law from the University of Liverpool in the United Kingdom, Murjanatu Mohammed Audu said, “I am beyond grateful for the opportunity that AIG has given me. I have a passion for public service and believe in my ability to lead transformations in the public sector.
The AIG Scholarship provides me with a platform to build my capacity and contribute to the emergence of an effective and efficient public service in Nigeria.”
Another 2020 AIG Scholar and first class Electrical and Electronics Engineering graduate of Covenant University in Nigeria, Uchechukwu Nwokediuko said, “I believe the public sector is a platform through which I can make impact at scale. One of the things I hope to gain at the Blavatnik School of Government is a refreshed way of thinking on how to deliver positive change through governance, especially in uncertain and difficult times.”
AIG also announced the opening of the application window for the 2021/2022 AIG Scholarships. The application window will close on Thursday, October 15, 2020.

6 out of 10 kidnapped FRSC officers still in custody of bandits in Nasarawa
Commissioner of Police in Nasarawa State, Bola Longe, yesterday, said that six out of 10 officers of the Federal Road Safety Corps (FRSC) that were attacked and kidnapped by bandits were still held by their abductors.
Longe said the police had succesfully rescued four of the FRSC personnel that were abducted.
The CP who briefed newsmen after state security council meeting in Lafia, revealed that men of the command, with effort of combined security operatives have launched an onslaughts action against the bandits.
On Monday, two officers of the FRSC were confirmed killed, while six were injured and ten others kidnapped, after gunmen attacked two buses conveying 26 officials through Nasarawa State.
Sources revealed that the convoy of the FRSC officers was headed to the Corps’ Academy in Udi, Enugu State when bandits attacked them along Udege junction situated between Adoka community, along Mararaban-Udege in Nasarawa State.
However, the Police CP yesterday said “with the combined efforts of the security agencies, particularly the police and military, we carried out an onslaught against the bandits.
“We modified the aggression and we checkmated their wicked antics and put them in panicking situation and they ran into different direction.
“On the basis of that, some of the victims of the kidnappers were able to escape and in the process, the security agencies were able to rescue four of them out of the 10 that were kidnapped . Only 6 are with the kidnappers, but we are really monitoring the situation and our personnel are advancing against the bandits and by the grace of God, we will rescue them alive in the hands of the kidnappers” the revealed.
Nigerian man makes history becomes first Black councillor in Germany
This makes him the first Councillor of African origin in Cologne, Germany’s 4th biggest city with about 1 million inhabitants.
On Sunday 13 September, millions of voters went to the polls in towns and cities across North Rhine-Westphalia, Germany’s most populous state, to vote for Lord Mayors, Mayors, Councillors and the Integration Councils.
Many candidates of African origin participated in the elections. Results are now coming in. Dr John Emeka Akude, a Nigerian-born political scientist, was elected member of the Cologne City Council (Stadtrat).
Reacting to Akude’s victory, Rahab Njeri, the only other African-origin candidate who took part in the election in Cologne said though she was not elected all African-descendant inhabitants of the city were winners with the victory of the Nigerian-born politician. Both ran on the platform of Klima Freunde (Friends of the Climate).
Other results that have been released show that several African candidates won elections into the Integration Council (Integrationsrat) in their cities and towns, including Kevin Uguru in Essen, Pastor Lumbu in Dortmund and Elizabeth Kaneza in Aachen.

A South African lady identified as @Misst_Thembs on twitter took to the platform to share a story about how her husband poured petrol and set her on fire. The woman who narrowly escaped death described her story to be an unforgettable one because it almost took her life.
According to the lady, she got into an argument with her husband and he decided to pour petrol on their daughter and herself and locked them inside the room to burn into ashes. She mentioned that their daughter did not make it out alive but she managed to survive.

Lagos businessman dies in Train accident while attempting to save son in SUV

A Lagos trader who deals with shoes, Christopher Ngobidi, has been crushed to death by a train around the Nigerian Army Shopping Arena, Oshodi, Lagos State.
According to reports, Christopher Ngobidi was waiting for the gate of the shopping mall to open when he saw the approaching train which had earlier collided with a white Ford Ecoline 250 bus with number plate, GGE 972 GE, at the PWD area.
The train, while pulling the Ford vehicle, got to the Army Shopping Arena, where Ngobidi parked his Toyota Highlander on the rail tracks.
On seeing the train approach,Ngobidi raced to the vehicle to rescue his son, who was sleeping in the vehicle, but was crushed to death by the train.
A witness, Hezekiah Adekanmi, said, “The man parked on the rail track while he was waiting for the Arena gate to be opened. While the train was coming with a bus that it had earlier hit, it started honking. But the man, who was not in the car, remembered that his son was inside the vehicle and he ran to rescue him.

“Before he could come out of the vehicle, they were hit by the train and pushed inside a gutter. The man died immediately, while his son was injured. The train still dragged the bus to the Oshodi under bridge before it stopped.”
One of the shop owners around Ngobidi’s shop, Efechukwu Udeh, who described the deceased as a nice man, lamented that he would be sorely missed.
He said, “Christopher (Ngobidi) was my neighbour in this market and he was nice to everybody.
“The man attempted to rescue his son who was sleeping inside the vehicle when the train crushed him, while his son was injured. The boy is unconscious at the hospital. Christopher’s wife called me this morning to ask after the husband, but I had to lie to her that he had not got to the market yet because I don’t know what to tell her.”
The Head of Public Affairs of LASEMA, Nosa Okunbor, confirmed the report saying “Upon arrival at the scene, it was discovered that a white bus, with number plate GGE 972 GE, veered onto the rail tracks while crossing the railway line at the PWD inward Oshodi and subsequently collided with a scheduled commuter train.
“The bus was dragged along by the train for a stretch of the journey before managing to come to a complete halt at the Oshodi under bridge.
“It was also gathered that while the train was pulling the bus, it crashed into a stationary Toyota Highlander Sport Utility Vehicle, with the number plate FST 763 FL. The driver of the SUV lost his life during the incident, while his son, who was with him in the SUV was taken to One Life private hospital, opposite the Arena, Bolade, Oshodi.”
A 50 years old woman docked for N2.4m American visa fraud

A 50 years old Yoruba woman, Folashade Odujole on Monday appeared before an Ota Magistrates’ Court in Ogun state after she was charged with American visa fraud, a crime she allegedly committed two years ago.
Odujole whose address was not stated in court, is facing a two-count charge of obtaining money under false pretence and fraud.
The prosecuting officer, Insp. E.O. Adaraloye, told the court that Odujole committed the offences sometime in July 2018 at Adalemo area, Sango-Ota.
Adaraloye said that defendant collected N2.4 million from the complainant, Micheal Opaleye, to assist him to procure America visa, which she did not carry out.
“The defendant converted the money to personal use instead of fulfilling the agreement between them,” he said.
Adaraloye said that the offences contravened Sections 419 and 516 of the Criminal Code Cap 38, Law of Federation 2004.
Odujole pleaded not guilty to the charge.
The Magistrate, Mrs A.O. Adeyemi, admitted Odujole to bail in the sum of N500,000 with two sureties in like sum.
Adeyemi said that the sureties must reside within the court’s jurisdiction and be gainfully employed with evidence of tax payment to Ogun Government.
The case was adjourned till 30 September for hearing.
